This Privacy Policy (the “Privacy Policy”) describes the information WorldQuant Educational Technologies (D.B.A. WorldQuant Learning) and its affiliates and subsidiaries (“we,” “us,” “our,” or other similar pronouns) may collect when you use this website wqlearning.com (the “Website”), all related websites, and/or any capability, software, or web-based service that may be made available through the Website (collectively, the “Services”) and how may we use that information.

This Privacy Policy is incorporated into, and is part of, the Website Terms of Use.

Our Services are intended exclusively for customers in their capacity as employees or other representatives of businesses. Personal information regarding these contacts is exempt from certain federal and state laws. We have provided disclosures regarding such personal information in this Privacy Policy in the interest of transparency and our commitment to privacy; such disclosures and rights are not intended to waive any applicable exemptions under federal and state laws as to business-to-business data or any other exempt dataset.

1. Information We Collect

For the purposes of this Privacy Policy, “personal information” means individually identifiable information about an individual consumer that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a specific individual, household, or device. Personal information includes “personal data” as that term is defined in applicable privacy laws.

We may create aggregated, de-identified, or anonymous information from data by removing certain data components (such as your name, email address, or linkable tracking identifier) that makes the data identifiable, or through aggregation, obfuscation or other means. Subject to applicable law, our use and disclosure of such aggregated, de-identified, or anonymized information is not personal information or subject to this Privacy Policy.

We collect personal information from users of the Website and natural persons who register to use the Services on the Website and/or submit information or materials on the Website, including, for example, when users apply to become users of the Services or submit other information or materials on or through the Website or the Services, send us an e-mail, or in any other way submit personal information to us via the Website.

The personal information we may collect includes:

  • Contact information you provide to us (such as name and e-mail address);

  • Information related to your education or occupation you may provide when you register to use our Services;

We may automatically collect information from the computers and devices you use to access the Services through cookies and other tracking technologies such as web beacons, embedded scripts, browser analytics tools, web server logs, and tags., including:

  • Browser and device data. When you use our Services, we may automatically collect information such as IP address, geolocation data, device identifier, device type, operating system and Internet browser type, screen resolution, operating system name and version, device manufacturer and model, language, plug-ins, add-ons, and the language version of the Services you are visiting.

  • Usage data. When you use our Services, we may automatically collect information such as browsing history, time spent on the Services, pages visited, links clicked, language preferences, patterns of use, and the pages that led or referred you to our Services. We also collect information about your online activities on websites and connected devices over time and across third-party websites, devices, apps, and other online features and services.

c. Information we obtain from other sources

We may also get information about you from third parties, including:

  • Service providers. We may collect information from our business partners or vendors, including as professional service providers who may provide information for us to carry out credit and money laundering checks, communications providers, and analytics providers. 

  • Social media and other content platforms. We may information if you interact with us on social media and other content platforms, such as X, Facebook, Instagram, LinkedIn, and YouTube. 

If we collect any non-personal information from these third parties with personal information that you provide to us, the information will be treated as personal information in accordance with this Privacy Policy.

2. How We Use Your Information

We use your personal information for the following purposes:

  • as described herein for our legitimate business interests;

  • in order to comply with applicable law and regulations;

  • in order to establish, exercise or defend our legal rights or for the purpose of legal proceedings; or

  • to the extent we have obtained your consent.

More specifically, we may use your personal information for the following legitimate business interests:

  • to operate, maintain or improve the Website, the Services or our business;

  • to contact you or respond to your requests or inquiries;

  • to support auditing, legal or compliance functions;

  • to provide the Services;

  • to create and manage online accounts;

  • to send promotional materials, alerts and other communications, which may be through the Website or outside of the Website, such as via e-mail or through third party websites and/or apps;

  • to optimize the Services and understand usage patterns and user behavior;

  • for targeted advertising, and to understand the usefulness to you of the advertisements or content that have been delivered to you;

  • for systems and data security; 

  • to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about the users of our Sites is among the assets transferred; 

  • to communicate about, and administer participation in, special events; promotions, programs, offers, surveys, contests and market research; and/or

  • to maintain our internal records.

Notwithstanding the above, we may use information that does not identify you (including information that has been aggregated, anonymized, or de-identified as those terms are defined by applicable law) for any purpose to the extent permitted by applicable law.

3. How We Disclose Your Information

We may disclose your information to the following categories of third parties:

  • Our affiliates and subsidiaries. We may share your information within our organization, including to our affiliates.

  • Service providers. We may disclose your information to service providers to provide services on our behalf, including those that provide professional, legal, tax, or accounting advice or other services such as analytics, advertising, hosting, marketing, and customer and technical support. All such service providers are required to maintain the confidentiality of such information to the extent they receive it. 

  • Advertising platforms. We may disclose your personal information to third-party platform providers who assist us in serving advertising to others who may be interested. 

  • Compliance and harm prevention. We may disclose your information or any portions thereof: (a) as required by, or to comply with, applicable law, regulation, court process or other statutory requirement or to enforce our legal rights or agreements with you or others; (b) to respond to requests from any regulatory, supervisory or governmental authorities; or (c) where we have reason to believe that someone is causing injury to or interference with our rights or property, other users of the Website or Services, or anyone else that could be harmed by such activities.

  • Business transfers and transactions. If we or any of our affiliates are involved in a transaction of merger, division, liquidation, acquisition or sale of assets or business, your information may be disclosed in connection with the transaction.

  • Other third parties as stated in this Privacy Policy or with your consent. We may share your information with our third party business partners and/or with other third parties for the purposes as stated in this Privacy Policy or for other purposes disclosed to you. We may also disclose your information where you direct us to disclose the information, or with your consent.

Notwithstanding the above, we may disclose publicly available information (as that term is defined by applicable law) or information that does not identify you (including information that has been aggregated or de-identified as those terms are defined by applicable law) to the extent permitted by applicable law.

4. Cookies and Other Tracking Technologies

We use cookies and similar tracking technologies to track the activity on our Websites. Cookies are small text files containing a string of characters that can be placed on your computer or mobile device that uniquely identify your browser or device and which are transmitted back to us by your computer(s) or mobile device(s). The information from cookies and related tracking technologies is stored in web server logs and also in web cookies kept on your devices, which are then transmitted back to us by your devices.

These cookies are managed by, us, our business partners and/or our service providers. For example, when you access the Website, we may place cookies on your computers or mobile devices. Cookies can store information about your registration and your use of the Website. c. Advertising choices

The companies we work with to provide you with Interest-based Advertising may be participants of the Digital Advertising Alliance (“DAA”) and/or the Network Advertising Initiative (“NAI”). To opt out of receiving Interest-based Advertising from the participating companies, please visit https://www.aboutads.info/choices and https://www.networkadvertising.org/choices/ for website opt outs and https://www.aboutads.info/appchoices for mobile opt outs. Note that opting out through these links only means that the selected participants should no longer deliver Interest-based Advertising to you, but does not mean that the participants will not process your information for Interest-based Advertising purposes or that you will no longer receive Interest-based Advertising from other companies.

Opting out only means that the selected participants should no longer deliver certain targeted ads to you, but does not mean you will no longer receive any targeted ads (e.g., in connection with the participants’ other customers or from other technology services).

5. International Transfer of Information

We are based in the U.S. and the information we collect is governed by U.S. law. Some of the uses and disclosures of information mentioned in this Privacy Policy may involve the transfer and processing of your personal information to and in various countries that may have different levels of privacy protection than your home country.

Where your information is transferred outside of your jurisdiction, we will take measures designed to ensure that the transfer is subject to appropriate safety measures (which may be contractual in nature).

In particular, where we transfer your personal information from within the EU to another country outside the European Economic Area (the EEA), we will take measures designed to ensure that it is transferred in a manner consistent with legal requirements, such as through standard contractual clauses.

6. Data Retention

We take the protection of your personal information seriously, and have security measures, controls and policies in place. We will hold your personal information on our systems for the longest of the following periods: (a) as long as is necessary for the relevant activity or as long as is set out in any relevant agreement you enter into with us; (b) the length of time it is reasonable to keep records to demonstrate compliance with professional or legal obligations; (c) any retention period that is required by law; or (d) the end of the period in which litigation or investigations might arise in respect of your use of our Website and/or the Services that we provide to you.

7. Security

We utilize reasonable security measures appropriate to the provision of the Services, such as reasonable administrative, technical, personnel, and physical measures designed to: (a) safeguard personal information against loss, theft, unauthorized use, disclosure, or modification; and (b) ensure the integrity of personal information. However, while we will endeavor to protect the security and integrity of your personal information, due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that any information will be absolutely safe. 

Additionally, if you contact us by e-mail or the "Contact Us" or similar feature on the Services, you should be aware that your transmission mechanism might not be secure. We encourage you to always protect your accounts with a strong password and to keep your passwords private.

8. Third Party Websites

This Privacy Policy does not apply to third-party websites. Other third-party websites that may be accessible or linked through the Website have their own privacy policies and data collection, use and disclosure practices. If you access any such website, we urge you to review its privacy policy. We are not responsible for the policies or practices of third parties, including those of any sites, apps or services not owned by us.

9. Children’s Data

We do not collect or maintain information from anyone known to be under the age of 18, and no part of the Website or Services is designed to attract anyone under the age of 18. You must be over the age of 18 in order to sign up for the Services.

10. Opting out of Promotional Communications

You may opt-out of any emails that we send for promotional purposes by clicking the “unsubscribe” links provided at the bottom of those emails. Please note that if you opt out of receiving promotional emails from us, we may still send you important administrative messages that are required to provide you with our Sites or services or for other reasons disclosed in this Privacy Policy. You will continue to receive these emails, if appropriate, even if you unsubscribe from our optional communications.

11. Privacy Notice for Individuals in the EEA, UK, and Switzerland 

This Notice applies to any individuals located within the European Economic Area (“EEA”), the United Kingdom (“UK”), and Switzerland about whom we may have collected personal information from any source, including through your use of the Sites. We provide this Notice in addition to the disclosures throughout the rest of this Privacy Policy to comply with applicable privacy laws, including the General Data Protection Act (“GDPR”), the UK GDPR, Switzerland’s Federal Act on Data Protection, and related laws, regulations, and guidance from the European Union and/or its member states (collectively, “European Privacy Laws”). WorldQuant Learning is what is known as a “data controller” for the purposes of the European Privacy Laws. 

a. Legal bases for processing

We rely on one or more legal bases to process your personal information under applicable law. We may process personal information (i) as necessary to perform our contractual obligations to you, including, but not limited to, those obligations in our Terms of Service; (ii) as necessary to pursue our legitimate business interests as further detailed below; (iii) as necessary for our compliance with our legal obligations such as a request or order from courts, law enforcement or other government authorities; and/or (iv) with your consent, including to send you marketing email messages and other information that may be of interest to you, which you may withdraw at any time. 

b. Legitimate business interests

We may collect, process, and maintain personal information to pursue the legitimate business interests outlined below. To determine these legitimate interests, we balance our legitimate interests against the legitimate interests and rights of you and others and only process personal information in accordance with those interests where they are not overridden by your data-protection interests or fundamental rights and freedoms. Our legitimate interests generally include:

  • Providing, improving, and developing our Services, including to deliver your requested services, send you messages and provide user support, customize the Sites to better fit your needs as a user, develop new products and services, and perform internal analytics and research and development. This also includes sharing personal information with our trusted service providers that provide services on our behalf.

  • Protecting you and others and to create and maintain a trusted environment, such as to comply with our legal obligations, to ensure compliance our agreements with you and other third parties, to ensure safe, secure, and reliable Sites, and to detect and prevent wrongdoing and crime, assure compliance with our policies, and protect and defend our rights, interests, and property. In connection with the activities above, we may conduct internal research and profiling based on your interactions on various Sites, content you submit to the Sites, and information obtained from third parties. 

  • Providing, personalizing, measuring, and improving our marketing, including to send you promotional messages and other information that may be of interest to you with your consent. We may also use personal information to understand our user base and the effectiveness of our marketing. This processing is done pursuant to our legitimate interest in undertaking marketing activities to offer products or services that may be of interest to you. 

c. Privacy rights 

In certain circumstances, individuals located within the EEA, UK, and Switzerland are entitled to the following privacy rights:

  • Right to access: You have the right to make a written request for details of personal information about you held by us and a copy of that personal information

  • Right to rectification: You have the right to have inaccurate or incomplete information about you rectified;

  • Right to erasure (“right to be forgotten”): You have the right to have certain personal information about you erased. Please note that there may be circumstances where you ask us to erase your personal information but we are legally entitled or required to retain it;

  • Right to object to or restrict  processing: You have the right to object to our processing of your personal information and the right to request that we restrict the processing of your personal information. Again, there may be circumstances where you object to, or ask us to restrict, our processing of your personal information but we are legally entitled to refuse that request;

  • Right to data portability: In some circumstances, the right to ask for personal information you have made available to us to be transferred to you or a third party in machine-readable formats where this is technically feasible. Please note that this right only applies to personal information which you have provided directly to us; and

  • Right to withdraw consent: You also have the right to withdraw your consent at any time where we rely on your consent to process your personal information. Please note, however, that we may still be entitled to process your personal information if we have another legitimate reason for doing so. For example, we may need to retain personal information to comply with a legal obligation.

  • Right to lodge complaint:  You have the right to complain to a Data Protection Authority about our collection and use of your personal information. This Notice applies to California residents who are users of our Services. The provisions in this Notice are intended to provide disclosures in compliance with the California Consumer Privacy Act (“CCPA”) and other relevant California laws and regulations.

We limit our disclosure of the categories of personal information above to our service providers for one or more business purposes. “Business purposes,” means the reasonably necessary and proportionate use of personal information for our operational purposes, other purposes described in this Privacy Policy, for the operational purposes of our service providers and contractors, as well as other purposes compatible with the context in which the personal information was collected.

We do not and have not sold personal information to third parties for any monetary value.  We do gather personal information from users via cookies and other tracking technologies as part of our targeted advertising initiatives, which is technically considered a “sale” and/or “share” of personal information under the CCPA, even though we do not receive monetary payment for sharing or disclosing personal information to these third parties. Accordingly, during last 12 months (from the last updated date listed at the top of this Privacy Policy), we have “sold” or “shared” the following categories of personal information as those terms are defined under the CCPA:

  • Identifiers

  • Commercial information

  • Audio, electronic, visual, or similar information

  • Internet or other electronic network activity information 

  • Geolocation data

  • Inferences 

The categories of third parties to whom we may sell or share your personal information include, where applicable, vendors and other parties involved in cross-context behavioral advertising.

d. Your privacy rights

Subject to certain limitations, California residents have the following rights under California law: 

  • Right to know and access. You have the right to know what personal information we collect, use, disclose, and sell and/or share, as those terms are defined under applicable law. You may ask us to provide you a portable copy of this information up to two times in a rolling twelve-month period.

  • Right to delete and erase. You have the right to request under certain circumstances that we, as well as our service providers and contractors, delete the personal information that we collect about you.

  • Right to correct. You have the right to request the correction of inaccurate personal information.

  • Right to non-discrimination. You have the right not to receive discriminatory treatment for the exercise of the privacy rights described above.

  • Right to opt out of sale and/or sharing. You have the right to opt-out of the sale and/or sharing of your personal information. 

  • Right to limit use and disclosure. You have the right to limit the use or disclosure of your sensitive personal information to only the uses necessary for us to provide goods or services to you. We will not use or disclose your sensitive personal information after you have exercised your right unless you subsequently provide consent for the use of your sensitive personal information for additional purposes. 

  • Sharing with third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their own purposes without your consent.  If you wish to request information regarding such practices under California’s “Shine the Light” Law, please Contact Us. You must include your full name, email address, and postal address in your email or mail request so that we can verify your California residence and respond.

You may designate an authorized agent to submit a request on your behalf, and if so, we may require proof of the agent’s authorization by you and/or verification of the agent’s own identity.

Please note that any request you submit to us is subject to an identification and residency verification process as permitted under California law. Generally, a rights request must include:

  • Sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which must include, at a minimum, your first and last name and email address.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to the request.

You are not required to create an account with us to submit a request. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

We do not charge a fee to process or respond to your verifiable consumer request unless its excessive, repetitive, manifestly unfounded, or in accordance with applicable law. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We will confirm receipt of your request within 10 business days.  Except where otherwise noted, we will respond to your request within forty-five (45) days after receipt and we reserve the right to extend the response time by an additional forty-five (45) days when reasonably necessary and provided consumer notification of the extension is made within the first forty-five (45) days.

e. Notice of right to opt-out of sale/sharing

You have the right to opt-out of the sale and/or sharing of your personal information by a business. As noted above, we may “sell” and/or “share” your personal information for purposes of cross-context behavioral advertising. You can opt out of such sale or sharing by emailing us at info@wqlearning.com or visiting Your Privacy Choices. 

We do not knowingly sell or share the personal information of children under 16 years of age without legally required affirmative authorization. If you believe that your child has provided us with information, please Contact Us.  

f. Retention of personal information. 

We take the protection of your personal information seriously, and have security measures, controls and policies in place.
